These Terms and Conditions govern the provision of design services by Kitchen Plans ("we", "us", "our") to the client ("you", "your").
By instructing Kitchen Plans and making payment for our services, you agree to these Terms and Conditions.
1. About Kitchen Plans
Kitchen Plans is an independent residential design consultancy based in Ireland.
We provide planning and design services for:
Kitchens, Utility Rooms, Pantries, Boot Rooms. Bedrooms, Walk-In Wardrobes, Bathrooms, Media Walls, Home Offices & Other residential interior spaces
Kitchen Plans does not manufacture, supply or install furniture, kitchens, appliances, worktops, fixtures or fittings.
2.Independent Design Service
Kitchen Plans operates independently of manufacturers, retailers and installers.
Our recommendations are based on design suitability, practicality and client requirements.
Any contracts for products, materials, installation or construction works are entered into directly between the client and the chosen supplier or contractor.
Kitchen Plans accepts no responsibility for the performance, pricing, delivery or workmanship of any third-party supplier or contractor.
3. Scope of Services
The services provided may include:
Design consultations, Space planning, Layout development, 3D visualisations, Design revisions, Service location guidance, Design specifications & Design documentation.
The exact scope of work will be agreed before commencement of each project.
4.Client Responsibilities
The client agrees to provide accurate:
Measurements, Drawings, Plans, Photographs, Site information & Project requirements
All designs are produced based on information supplied by the client.
Kitchen Plans is entitled to rely upon information supplied without independently verifying its accuracy.
5. Site Surveys & Verification
All dimensions shown on drawings and visualisations are for design purposes only.
Before ordering any products or commencing construction works, the client must ensure that all dimensions, specifications
and site conditions are independently checked and verified by:
Kitchen suppliers, Furniture manufacturers, Installers, Builders, Contractors & Tradespeople.
Kitchen Plans accepts no responsibility for losses resulting from inaccurate measurements supplied by the client or third parties.
6.Design Revisions
Unless otherwise agreed in writing:
Design fees include up to two rounds of revisions.
Additional revisions may incur additional charges.
Significant changes to the project brief may require a revised quotation.
7.Design Timeframes
Estimated delivery times will be provided at the commencement of the project.
Delivery times are estimates only and may vary depending on:
Project complexity, Client response times, Information supplied, Workload and scheduling.
Kitchen Plans shall not be liable for delays outside its reasonable control.
8. Fees & Payment
Design Fees & Payment
All design fees will be agreed and confirmed before any work commences.
Payment in full is required before the commencement of any design work. No surveys, consultations, drawings, visualisations, plans or design services will be undertaken until full payment has been received and cleared.
All fees are payable in Euro (€).
Kitchen Plans reserves the right to decline, postpone or suspend any project where payment has not been received in full.
Unless otherwise agreed in writing, all design work, drawings, plans, specifications and visualisations remain the property of Kitchen Plans until payment has been received in full.
9.Cancellations & Refunds
Clients purchasing services online may have rights under applicable Irish consumer legislation.
Where a client requests work to commence immediately, the client expressly agrees that Kitchen Plans may begin providing
services before the expiry of any statutory cooling-off period.
If a project is cancelled after work has commenced, Kitchen Plans reserves the right to retain payment for work completed up to the cancellation date.
Any refund shall be limited to the portion of work not yet completed.
10. Intellectual Property
All drawings, plans, visualisations, renders and design documentation remain the intellectual property of Kitchen Plans.
Upon full payment of all fees, the client receives a licence to use the design documents solely for:
Obtaining quotations, Constructing the project & Completing the project
Designs may not be reproduced, resold, copied, published or commercially exploited without written permission.
Kitchen Plans reserves the right to use completed designs and visualisations for marketing, portfolio and promotional purposes unless otherwise agreed in writing.
11.Limitation of Liability
Kitchen Plans shall not be liable for:
Inaccurate measurements supplied by clients or third parties, Manufacturing errors, Installation errors, Supplier errors, Structural issues, Building regulation compliance, Planning permission matters, Engineering matters, Architectural matters, Product availability, Product pricing or Changes made by third parties
To the fullest extent permitted by law, Kitchen Plans' total liability shall not exceed the design fee paid by the client for the relevant project.
Nothing in these Terms excludes liability where such exclusion is prohibited by law.
12.Professional Advice
Kitchen Plans provides design and planning services only.
Our services do not constitute:
Architectural services, Structural engineering services, Quantity surveying services, Building regulation certification, Legal advice
or Planning consultancy
Where specialist advice is required, clients should engage appropriately qualified professionals.
